1. Scope
Sky Vanilla Pte. Ltd. ("Sky Vanilla", "we" or "us") offers Virtual Items (as defined in Section 4.1 of our Terms of Service) for purchase on the Cinder & Crowns website at cnc.skyvanillagames.com (the "Website"). These Payment Terms (these "Terms") apply to all purchases made on the Website and supplement our Terms of Service. In the event of any conflict regarding a purchase made on the Website, these Terms shall prevail.
2. Purchases and Delivery
By clicking the purchase button on the Website, you (a) agree to purchase the selected Virtual Items; (b) request that Sky Vanilla supply such Virtual Items immediately upon successful payment; and (c) authorize a charge at the price quoted at the time of purchase. Virtual Items are credited to the game account associated with your login (your "Account") upon successful payment. Virtual Items are licensed, not sold; they have no monetary value, may not be exchanged for cash and may not be transferred to any other account. Virtual Items may not be sold, exchanged or transferred outside the Website and the game; doing so breaches these Terms, and we may terminate the Account and reserve all other remedies.
3. Prices and Taxes
Prices are quoted in United States dollars and are subject to change; the price displayed at the time of purchase applies. You agree to pay all applicable charges, including any taxes incurred by you, in accordance with the billing terms in effect when the charge becomes payable. The amount and currency actually charged are determined by the Payment Processor at the prevailing exchange rate and may differ from the quoted price. The availability of Virtual Items may also change or be discontinued without notice.
4. Payment Processing
Purchases on the Website are processed by a third-party payment processor (the "Payment Processor"), whose terms of service also apply. The Payment Processor collects the billing and financial information required to process your payment. Sky Vanilla does not collect or store your card number. The Payment Processor may share information related to your purchases with us, which we will use in accordance with our Privacy Policy, including to fulfil your purchases, comply with our legal obligations, resolve disputes and enforce our agreements.
5. All Sales Final
Before completing a purchase, you must expressly consent to the immediate supply of Virtual Items and acknowledge that you thereby lose any statutory right of withdrawal. Accordingly, except as required by applicable law, all sales of Virtual Items are final and non-refundable, save that you may contact our customer support with your Website order number where (a) payment was completed but the Virtual Items were not credited to your Account, in which case we will credit the Virtual Items or refund the payment; or (b) you were charged more than once for the same purchase, in which case we will refund the duplicate charge. We keep a record of your consent, including the time it was given and the version of these Terms that applied. The transaction is complete upon our receipt of payment. Where an Account is closed, these Terms end or the service is discontinued, unused Virtual Items are not exchanged for money or otherwise compensated, whatever the reason for the closure. Where a refund is required by applicable law, the payment provider's terms also apply and any related fees are borne by you.
6. Chargebacks and Account Suspension
You are responsible for, and agree to reimburse us for, all reversals, chargebacks, claims, fees, fines, penalties and other liabilities (including related costs) incurred by us arising out of payments you authorized. We may suspend or terminate your Account if a charge cannot be processed or is returned unpaid, if you initiate a chargeback without first contacting our customer support, or if we find evidence of fraud, abuse or other unlawful or manipulative conduct.
7. Other Terms
These Terms should be read together with our Terms of Service and Privacy Policy, and are governed by the laws of the Republic of Singapore.
