1. Acceptance of Terms

Welcome to Cinder & Crown and related services (collectively, the "Service"), developed and operated by Sky Vanilla Pte. Ltd. ("Company," "we," "us," or "our"), incorporated in Singapore.

By accessing, downloading, installing, or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to any part of these Terms, please do not use the Service.

We may modify these Terms at any time. Material changes will be communicated via in-game notification or other reasonable means. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

2. Accounts

2.1 Account Registration

Certain features of the Service may require you to create an account or sign in through a third-party service (e.g., Apple, Google, Facebook). You must:

  • Provide truthful and accurate information.
  • Keep your account credentials secure and not share them with others.
  • Be responsible for all activity that occurs under your account.

If you discover unauthorized use of your account, please contact us immediately at cinderandcrowns@skyvanillagames.com.

2.2 Account Security

We are not liable for losses resulting from your failure to protect your account information. We strongly recommend using a strong password and enabling available security features.

2.3 Account Deletion

You may request deletion of your account at any time through the in-game Settings menu. Once deleted, your personal data will be handled in accordance with our Privacy Policy. Please note that account deletion is irreversible, and all game progress, virtual items, and purchase records associated with the account will be permanently lost.

3. License to Use

3.1 Limited License

Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable, limited license to download, install, and use the Service for your personal, non-commercial entertainment purposes.

3.2 Restrictions

You may not:

  • Copy, modify, adapt, translate, reverse engineer, decompile, or disassemble any part of the Service.
  • Use the Service for commercial purposes, including but not limited to selling accounts, virtual items, or in-game currency.
  • Use any automated tools, scripts, bots, hacks, or cheating programs.
  • Exploit bugs or errors in the Service to gain unfair advantages.
  • Interfere with or attempt to disrupt the normal operation of the Service, including servers and networks.
  • Access other users' accounts or personal information without authorization.

4. Virtual Items and In-Game Currency

4.1 Nature of Virtual Items

The Service may include virtual currency, virtual goods, or other content obtainable through purchase or in-game activities (collectively, "Virtual Items"). Virtual Items are licensed features of the Service and are not your property. You have no ownership or proprietary interest in Virtual Items.

4.2 Purchases

  • Purchases of Virtual Items are made through the in-app purchase mechanisms of the Apple App Store or Google Play Store (collectively, "Platform Stores").
  • All purchases are final. Virtual Items are non-refundable once purchased, except as required by applicable law or permitted by Platform Store refund policies.
  • Prices may vary by region, currency, and promotional activity. We reserve the right to adjust prices at any time.

4.3 Virtual Currency

  • In-game virtual currency does not expire.
  • Virtual currency cannot be exchanged for real-world currency, and cannot be transferred or traded outside the Service.
  • We reserve the right to adjust the value or exchange rate of virtual currency with reasonable notice.

4.4 Purchase Restoration

If you change devices or reinstall the Service, you may restore previously purchased non-consumable Virtual Items through the Platform Store's purchase restoration feature. Consumable items (such as already-used in-game currency) cannot be restored.

4.5 Randomized Items (Loot Boxes)

If the Service offers purchase options containing randomized Virtual Items, we will clearly disclose the odds of obtaining each item type prior to purchase.

5. Code of Conduct

When using the Service, you agree to:

  • Comply with all applicable laws and regulations.
  • Respect other users and refrain from harassment, abuse, threats, discrimination, or other inappropriate behavior.
  • Not distribute illegal, obscene, defamatory, infringing, or otherwise harmful content.
  • Not impersonate others or misrepresent your affiliation with any person or entity.
  • Not engage in fraudulent activities, including but not limited to exploiting bugs, using hacks, or conducting fraudulent transactions.
  • Not attempt to collect or store other users' personal information.

Violations of the above may result in warnings, suspension, or permanent termination of your account, at our sole discretion.

6. User-Generated Content

6.1 Definition

The Service may allow you to create, upload, or share content, including but not limited to chat messages, usernames, and player avatars (collectively, "User Content").

6.2 License Grant

By uploading or submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, display, and distribute such content for the purposes of operating and improving the Service.

6.3 Your Responsibility

You are solely responsible for the User Content you create and share. You represent and warrant that you own or have obtained the necessary rights to post such content and that it does not infringe any third-party rights.

6.4 Content Moderation

We reserve the right, but not the obligation, to review, monitor, edit, or remove any User Content. If you encounter violating content, please report it through the in-game reporting feature or via email.

7. Intellectual Property

7.1 Our Rights

The Service and all its content, including but not limited to game software, graphics, music, sound effects, text, logos, and user interfaces, are the property of the Company or its licensors and are protected by copyright, trademark, and other intellectual property laws.

7.2 Trademarks

"Cinder & Crown," "Sky Vanilla," and related logos are trademarks of the Company. You may not use these trademarks without our prior written consent.

7.3 Feedback

If you provide us with suggestions, ideas, or feedback regarding the Service ("Feedback"), you agree that we may use such Feedback without restriction or compensation to improve the Service.

8. Third-Party Services

The Service may contain links to third-party websites or services, or integrate third-party features (such as social media login, payment processing). We do not control these third-party services and are not responsible for their content, privacy policies, or practices. Your use of third-party services is subject to their respective terms and policies.

9. Subscription Terms

If the Service offers subscription-based content:

  • Billing Cycle: Subscriptions automatically renew at the interval you select (weekly/monthly/yearly) until you cancel.
  • Auto-Renewal: Unless you cancel at least 24 hours before the end of the current period, your subscription will automatically renew and you will be charged.
  • Cancellation: You may cancel your subscription through the subscription management feature of the Platform Store (Apple App Store or Google Play Store). Deleting the app does not automatically cancel your subscription.
  • Price Changes: If subscription prices change, we will notify you in advance. Updated pricing will take effect from the next billing cycle.
  • Free Trials: If a free trial is offered, it will automatically convert to a paid subscription at the end of the trial period unless you cancel before the trial ends.

10. Disclaimers

10.1 Service "As Is"

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by applicable law, we make no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation.

10.2 Service Modifications

We reserve the right to modify, update, suspend, or terminate the Service (or any part thereof) at any time without notice. This may include adding or removing features, adjusting game balance, or discontinuing support for specific devices or operating system versions.

10.3 Data Loss

While we endeavor to protect your game data, we do not guarantee against data loss. We recommend that you regularly back up your game data where supported.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Company and its directors, employees, partners, and agents shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising from or related to your use of or inability to use the Service, including but not limited to loss of profits, data loss, or damage to goodwill.
  • In no event shall our total aggregate liability to you for all claims arising from the Service exceed the amount you paid to us for the Service in the 12 months preceding the event giving rise to the claim, or SGD 100, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of liability for incidental or consequential damages, so the above limitations may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless the Company and its directors, employees, partners, and agents from and against any claims, losses, damages, liabilities, and expenses (including reasonable attorney's fees) arising from:

  • Your use or misuse of the Service.
  • Your violation of these Terms.
  • Your infringement of any third-party rights.
  • User Content you create or share.

13. Termination

13.1 Your Right to Terminate

You may terminate these Terms at any time by deleting your account and uninstalling the Service.

13.2 Our Right to Terminate

If you violate any provision of these Terms, we may suspend or terminate your access to the Service with or without notice. In cases of serious violations (such as cheating, fraud, or harassment), we may immediately and permanently terminate your account.

13.3 Effects of Termination

Upon termination:

  • Your license to use the Service terminates immediately.
  • You will lose access to your account, game progress, and Virtual Items.
  • We are under no obligation to refund any fees paid for Virtual Items.
  • Provisions of these Terms that by their nature should survive termination (including but not limited to Sections 4, 7, 10, 11, 12, and 15) shall continue in effect.

14. Minors

The Service is designed for users of all ages. If you are under 18 years of age (or the age of majority in your jurisdiction), you should use the Service under the supervision of a parent or legal guardian, and your parent or guardian must agree to these Terms.

Parents and guardians are responsible for all activities of their minor children within the Service, including purchases. If a minor has made an unauthorized purchase, please contact the relevant Platform Store (Apple or Google) to request a refund.

15. Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law principles.

15.2 Dispute Resolution Procedure

Any dispute arising from these Terms or the Service shall first be resolved through good-faith negotiation between the parties. If negotiations fail to resolve the dispute within 30 days, either party may submit the dispute to the Singapore International Arbitration Centre (SIAC) for arbitration in accordance with its rules then in effect. The seat of arbitration shall be Singapore, and the language of arbitration shall be English.

15.3 Class Action Waiver

To the extent permitted by applicable law, you agree to bring claims only in your individual capacity and not as a participant or representative in any class action or collective arbitration.

16. General Provisions

  • Entire Agreement: These Terms (together with the Privacy Policy) constitute the entire agreement between you and the Company regarding the Service, superseding all prior oral or written agreements.
  • Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
  • Assignment: You may not assign or transfer your rights or obligations under these Terms. We may freely assign these Terms.
  • Force Majeure: We shall not be liable for any delay or failure to perform obligations due to events beyond our reasonable control, including but not limited to natural disasters, war, pandemics, government actions, cyberattacks, or infrastructure failures.
